Quartermaster’s Clerk Habbeker and others, is probably true, from all indications. However, on account of protests and investigations in connection with this homestead, that of Seth Jones and that of Carter P. Johnson, with others, it appears that they have been caused to hesitate about carrying out their plan of the original lines.
An inspection of the county records at Harrison, Nebraska, shows that Cabeb [sic] Benson leased the land of his homestead to Carter P. Johnson on February 6, 1911, the period of the lease to be from March 1, 1911, to March 1, 1916, claimant being paid $100 a year; Johnson to protect all timber and wood; claimant to have use of the house, stable and garden; fence to be kept in repair by Johnson; Benson not to be allowed to give any permits for cutting or removing any of the timber.
Also the county records at Harrison, Nebraska, show a mortgage, in Book No. 9, page 127, whereby Cabeb [sic] Benson mortgaged to the mortgagees of the land on June 19, 1913, the DeMoulin Loan and Trust Company of Hot Springs, South Dakota, for a thousand dollars, interest at 6 per cent, payable semi-annually, the mortgage being due June 19, 1918.
