of Daniel Truax, and is occupied and used by him, he having entered the said tract under his preferential right; that affiant finds that by challenging his entry as requested he will include therein all the vacant land just as it comes, leaving the balance of the vacant land in a much more compact form and leaving no isolated or penned up tracts, and all the balance of the vacant land will be left contiguous thereby; also that by getting the tract asked for he can build on the SE ¼ NW ¼, Sec. 31, and be about a mile and a half nearer the school house, which is located on the SE ¼, Sec. 35, T. 32 N., R. 35 W.; that he has not relinquished or agreed to relinquish his entry for any consideration.
It is not alleged that the trach desired is any part of the land which the party originally intended to enter, nor is any reason given which would warrant the allowance of the amendment desired. The application is, therefore, denied. So advise Deaver and of his right to appeal.
Serve notice and make report under circular of March 1, 1900 (29 L.D., 649).
