Birnie of Fort Smith, County of Sebastian, State of Arkansas, do solemnly swear that I will faithfully execute all lawful precepts directed to the Marshal of the Western District of Arkansas, under the authority of the United States, and true returns make, and in all things well and truly, and without malice or partiality, perform the duties of the office of Deputy United States Marshal of the Western District of Arkansas, during my continuance in said office, and take only my lawful fees; and that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; and I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to inter, SO HELP ME GOD.”

An aged slip of paper titled, "Western District of Arkansas," dated November 22nd, 1897. Text reads: I, a duly commissioned and xx in and for Boone County, Arkansas, do hereby certify that on the 22 day of November 1897 when I administered the oath of office to James Baker as a Deputy United States Marshal in and for the Western District of Arkansas, that said oath was administered more than twenty miles from Fort Smith, Ark., the place where then Hon. J. H. Rogers, the Judge of the District Court of said District, at the time resided, and then was.
