Birnie of Fort Smith, County of Sebastian, State of Arkansas, do solemnly swear that I have never borne arms against the US since I have been a citizen thereof; that I have voluntarily given no aid, countenance, counsel or encouragement to persons engaged in armed hostility hereto; that I have neither sought nor accepted, nor attempted to exercise the functions of any office whatever, under any authority or pretended authority in hostility to the United States; that I have not yielded a voluntary support to any pretended government, authority, power or constitution within the US hostile thereto. I swear that I will support the constitution of the US; that I take this obligation freely, and will well and faithfully discharge the duties of the office on which I am about to enter. I swear I will faithfully execute lawful precepts directed to the Marshal of the Western District of Arkansas, and well and truly perform the duties of Deputy Marshal in office so help me God, July 31, 1871.”

An aged slip of paper titled, "Western District of Arkansas," dated November 22nd, 1897. Text reads: I, a duly commissioned and xx in and for Boone County, Arkansas, do hereby certify that on the 22 day of November 1897 when I administered the oath of office to James Baker as a Deputy United States Marshal in and for the Western District of Arkansas, that said oath was administered more than twenty miles from Fort Smith, Ark., the place where then Hon. J. H. Rogers, the Judge of the District Court of said District, at the time resided, and then was.
